THOMAS MYLREA jnr to PAUL QUIRK

Sale - 1753 (Douglas)

Know all men by these presents that I Thomas Mylrea jnr, son of Thomas Mylrea snr in the town of Douglas in the Isle of Man now living in Pargate [sic], mariner, but at present in the Isle of Man aforesaid, with the joint consent of Mary Mylrea my wife for diverse reasons use hereunto moving but more especially for the consideration of thirty two pounds ten shillings British value to be paid and satisfied unto me before the worshipful Deemster's attestation of these presents by my friend Paul Quirk of the said town of Douglas

Have given, granted, alienated, passed over and sold and by these presents do give, grant, alienate, pass over and absolutely sell from us, our heirs and assigns unto the said Paul Quirk, his heirs and assigns all the right, title and property that we now have and hereafter may have in and unto one half or moiety of the concerns of houses and garden situate in the said town of Douglas, now in the possession of my said father Thomas Mylrea, being the east half or moiety of the premises according as the same is lately divided by the Setting Quest and joining to Henry Cains rent and William Cry's rent on the east and north sides and to my said father Thomas Mylrea's half or moiety of the premises on the west and south sides and bearing the annual rent of 2 pence 1 farthing and 1/2 a farthing or the eighth part of a penny

To have and to hold the aforesaid half or moiety of the said houses and garden with all profits and advantages thereof accruing and all easements and liberties, ways and waters and watercourses and all other the appurtenances thereunto belonging unto him the said Paul Quirk, his heirs, executors, administrators and assigns taking commencement from the day of the date hereof, yielding and paying the rent aforesaid with all boons, suits and services annually incumbent on the premises

And I the said Thomas Mylrea jnr and Mary my wife oblige ourselves to uphold, awarrant and defend the premises unto the said Paul Quirk, his heirs and assigns against the pretended claim or title of any person or persons unto the same.

And for the faithful and punctual performance of all and singular the foregoing covenants and agreements, and every clause or sentence herein contained, I the said Thomas Mylrea jnr and Mary Mylrea my wife and also Paul Quirk do firmly bind ourselves, heirs, executors, administrator and assigns in the penalty of eighty pounds sterling to be levied and paid according to the law and practice of this Isle.

Thomas Mylrea and Mary Mylrea acknowledged the withing and above Bill of Sale to be their volluntary act and deed, and Paul Quirk acknowledged the same as far as concerns him to be his act and deed. Before me John Taubman

I Thomas Mylrea before mentioned do hereby acknowledge to be fully paid and satisfied the foregoing consideration money of thirty two pounds ten shillings British value by the foregoing Paul Quirk the purchaser and these before do acquit, exonerate and discharge the said Paul Quirk, his heirs, executors and assigns forever for the same. NOTES

  1. Thomas Mylrea jnr was the son of Margaret Lewn and Thomas McYlrea snr who married in Braddan in November 1717
  2. Thomas jnr was baptised 1721. His older brother Robert, baptised 1718, died in about 1750
  3. In 1748,Thomas MULRAY, sailor, married Mary Norton on 23rd February in the parish of St Nicholas, Liverpool. Like his father, he had two wives and many children
  4. The other administrator of the 1749 will of Ann Harrison was Ann Curlett als Cannell als Lewn, daughter of Robert Lewn, and Thomas's cousin
  5. This Quit Claim removed Thomas jnr from consideration as an heir when his uncle Thomas Harrison who died named his wife Ann Harrison als Lewn his major legatee. The consequence was that Ann Curlett als Cannell als Lewn became the major beneficiary of Harrison's will
  6. Mapping by Nigel Crowe shows that this cottage allotment was on Barrack St, with neighbours in 1705 Richard Killey (and Jane Mc ylrea), Robert Joyner (and Margaret Mc ylrea), Philip Higgin (and Jane Mc ylrea) and Thomas Mylroi
